Raffles, Lotteries, Games and Competitions Policy
The Ann Summers business model does not involve operating lotteries, raffles, and competitions of this type for our products. It is on this basis that we do not appoint Independent Brand Ambassadors to run raffles and any form of lottery to distribute Ann Summers products.
Raffles, when ran or promoted for private or commercial gain, are considered an illegal lottery by law.
There are three factors that make up a lottery in the UK:
- Pay to play
- A prize or prizes are awarded
- Random chance of winning
To clarify:
- You cannot run an online lottery without holding a valid Gambling license. This is explained on the UK Gambling Commission website.
- If an Ambassador holds a raffle which they and/or Ann Summers profit from financially, this constitutes an illegal lottery.
- If participants pay to enter a raffle, they must all receive a prize equal to the value that they paid at the end. If value for money is not given to all participants, this constitutes an illegal lottery.
Ambassadors involved in such activities could face prosecution under the Gambling Act of 2005, therefore posing risk to the reputation of the Ann Summers brand.
We reserve the right to terminate the Agreement and close the account of any Ambassadors found to have been running illegal lotteries, raffles, games or competitions under the following clause in the IBA Agreement:
10.5 The IBA understands that:
(a) they are appointed to sell the Products by direct sale to customers in accordance with section 5 of these Terms and Conditions. IBAs are not appointed to distribute the Products through the running of lotteries or raffles, though any games or competitions of any kind held by the IBA must be run lawfully. Accordingly, our Raffles and Lotteries Policy applies.
Should there be any element of doubt as to whether games advertised by an Ambassador are being run legally, we would also consider this a material breach of their Ambassador Agreement as this brings the brand into disrepute:
10.1 The IBA undertakes not to do anything that would negatively affect the interests of and to adhere to the Policies. Additionally, IBAs shall follow all legal requirements and good codes of practice and must not doing anything which would cause (or is likely to cause) any harm to the goodwill or reputation of Ann Summers or any of its Products.
